The terms to settle a Federal Bill on gambling protections and the prevention of gambling disorders will remain undecided in Argentina. 

The Senate of Argentina announced that it had chosen to postpone debates on the bill as its “text remains unresolved.” 

Discussions to settle the much-needed Bill are nearing the year mark, following its formative approval by the Chamber of Deputies in November 2024. 

As reported by SBC Noticias, the Bill remains under review by the Health Committee and is yet to be examined by the Committees of General Legislation, Justice and Criminal Affairs, which have not set a date for consideration.

What was intended as a fast-track legislative effort to implement federal rules on gambling (online and retail) has instead descended into another chaotic gridlock for Argentina Politics. 

The legislation, initially welcomed as a “consensus measure” has now been shelved until 2026, despite calls from ministers to see it adopted ahead of October’s municipal elections.

Senators not despair as “mounting industry pressure and inter-committee confusion” are detailed as reasons for the impasse. “We’re nearly a year in, and there is still no formal opinion. There was a clear window to act ahead of elections — that opportunity has now closed.”

At the centre of the delay is Article 8, a clause that would outlaw all forms of online gambling advertising across social networks, digital media, sports shirts and mass events  limiting marketing strictly to licensed physical venues. 

The proposal has sparked a backlash from industry stakeholders, with local media reporting heavy lobbying against the clause.

Councillor warns that BA will act alone

A Senate in paralysis,  Buenos Aires is taking matters into its own hands. Municipal councillor Diego Garciarena has relaunched a provincial bill to regulate online gambling, warning that the problem is growing unchecked.

“National legislation is stuck in the Senate, but the problem is here and now,” Garciarena told SBC Noticias. “Online gambling is booming among young people, and we simply don’t have the legal tools to respond.”

Garciarena’s bill proposes the mandatory use of biometric identification on gambling platforms, alongside a blanket ban on advertising to minors across media and social channels. Proposals have been lodged with the province’s Addiction Prevention Committee and are supported by a grassroots petition, launched via a public web portal to collect citizen signatures.

“I want to move this forward with public support. We can’t wait for another year of federal inaction,” Garciarena said.

Blame Game of another embarrassment 

The urgency is underscored by hard data. In October 2024, the Ombudsman of Buenos Aires released a report showing that nearly 25% of students aged 12 to 19 in the city had participated in online gambling activities.

The report sparked public outrage and intensified demands for regulation, but the national bill has since stagnated, caught in a tangle of committee bottlenecks and political hesitation.

One senior official told SBC Noticias: “This was a Bill that carried consensus. Ministers wanted it done by October. The Senate’s failure to deliver is a legislative embarrassment.”

With the debate pushed into 2026, Argentina risks regulatory fragmentation, as provinces like Buenos Aires pursue their own gambling frameworks in the absence of federal law.

Legal analysts have warned that such a split could undermine consumer protections and create enforcement loopholes. Meanwhile, public health groups continue to sound the alarm over the lack of coordinated response to rising gambling addiction amongst Argentine youth viewed increasingly as a toxic issue.
