Kansspelautoriteit (KSA), the Dutch gambling regulator, has continued its crackdown on gambling influencers.
The Dutch YouTuber ‘Leftlanepapi’, real name Djade Sadloe, has been handed an order subject to a penalty for broadcasting live streams and videos that promote online gambling at illegal providers.
The KSA has ordered the influencer to remove the content and refrain from advertising unlicensed operators in the future. If further violations take place, he will receive a penalty of €25,000 per instance, with a maximum of €75,000.
According to the KSA, its inspectors were alerted to a video on the Leftlanepapi YouTube channel which showed the influencer participating in gambling activities and mentioning specific slot games on a platform called Skyhills, which doesn’t hold a licence with the Dutch regulator.
The KSA notes that Sadloe stated in his video: “I always leave the stream up for twelve hours and then delete it immediately. You know how YouTube and the KSA are with me — I don’t want headaches.”
This indicates that he was aware of the rules surrounding such promotions but chose to ignore them.
The promotion of illegal gambling through YouTube and the participation in illegal gambling violate Articles 1(1)(b) and 1(1)(c) of the Dutch Gambling Act.
At the time of writing, videos remain on the Leftlanepapi YouTube channel that feature Sadloe engaging in gambling activities.
Two-track policy
The action against Sadloe forms part of the KSA’s new approach to illegal social media advertising.
Once a violation is established, the KSA contacts the influencer in question to inform they must stop their activities within 48 hours and their illegal content must be removed.
If the influencer fails to do so, the KSA will then approach the social media platform to remove the content, and the influencer will be subject to an order subject to a penalty.
The KSA has previously just warned several influencers. However, Leftlanepapi is the first to receive an official order from the regulator.
