The government of Argentina has mandated all online gambling licensees to comply with new fiscal controls and tax-reporting procedures.

The directive, led by ARCA, the Customs Collection and Control Agency, requires the implementation of a coherent and transparent fiscal architecture for gambling businesses, according to SBC Noticias.

Since 2018, Argentine law has allowed online gambling through provincial and city licences issued by autonomous authorities, a mandate allowed for 23 provinces and the City of Buenos Aires (BA) as the sole autonomous municipality.

In the absence of a federal framework, BA and 20 autonomous provinces have each developed independent online-gambling regimes. Yet, their systems differ widely in how they handle tax compliance, auditing, and operational procedures.

A divided patchwork has created serious transparency and enforcement challenges with each province applying its own fiscal rules and reporting standards. Operators active in several jurisdictions face overlapping obligations for tax submissions and player-data reporting.

As reported by SBC Noticias, ARCA officials admitted that the lack of integrated processes has led to “inconsistent and unreliable” fiscal results across provinces, prompting new controls to improve accountability and audit reliability.

ARCA intervention

Under General Resolution 5791/2025, ARCA will oversee the Online Control Registry of the Betting System, governing registrations, validations, and supervision of both domestic and foreign operators.

Though ARCA cannot levy new taxes, it will introduce standardised fiscal procedures requiring all gambling operators to report and withhold taxes in a consistent manner. Measures include digital certification of operators, regular audits, and a formal appeal mechanism for disputed decisions.

The reform forms part of a wider fiscal initiative to ensure that online-gambling operators “perform general economic measures” consistent with Argentina’s national governance model.

Debate on federal control

The new ARCA framework coincides with a heated debate over expanding federal oversight of Argentina’s gambling industry — despite provincial autonomy.

In 2025, the government approved the first federal advertising controls on gambling. Under the new rules, adverts must be concise, factual and limited to essential information, avoiding any exaggerated or misleading claims.

All advertising, regardless of licensing, must now carry two mandatory warnings: “Compulsive gambling is harmful to your health” and “online gambling is for +18.”

Further restrictions targeting social media and influencer promotions are being drafted. Oversight of gambling advertising has been assigned to AFSCA, Argentina’s Federal Communications Agency.

However, political parties have criticised the measures as too lenient, arguing they will have little impact on the rising problem of youth gambling. Lawmakers expressed frustration that a 16-month consultation process with key ministries resulted in such limited restrictions.

As provinces continue to expand their own gambling markets, calls are growing for a federal gambling authority to enforce uniform standards, fiscal controls, and compliance measures nationwide.

Yet such a proposal appears unlikely under President Javier Milei’s administration, which remains committed to a libertarian, free-market agenda and opposes the creation of new federal bodies.

For now, ARCA’s fiscal framework stands as the government’s most concrete step toward national coordination — even as the broader vision of federal oversight remains politically out of reach.
